By accessing or using homewisefl.com (the “Site”), you agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and all applicable laws and regulations. These Terms constitute a legally binding agreement between you and Home Wise Realty Group, Inc. (“HWRG,” “we,” “us,” or “our”).

If you do not agree to these Terms, you must immediately discontinue all use of the Site. Your continued use of the Site following the posting of any changes to these Terms constitutes your acceptance of those changes.

When you create an account on the Site, you will be presented with a checkbox explicitly acknowledging your acceptance of these Terms. Checking that box is a condition of registration and constitutes your electronic signature confirming your agreement.

HWRG is a licensed real estate brokerage in the State of Florida. All real estate activities conducted through or in connection with the Site are subject to Florida real estate laws and regulations, including Chapter 475, Florida Statutes.

The Site provides the following services to users:

• Real estate property search powered by MLS/IDX data feeds
• Agent directory to connect buyers and sellers with licensed agents
• Educational resources for buyers, sellers, and real estate consumers
• Mortgage calculator and home valuation request tools
• Property alerts and saved search functionality for registered users

The Site does not provide legal, financial, tax, accounting, or appraisal advice. Nothing on this Site should be construed as professional advice in any of these areas. Always consult a qualified professional for guidance specific to your situation.

No Brokerage Relationship Created by Site Use. Simply visiting or using this Site does not create a brokerage relationship between you and HWRG or any of its agents. Under Florida Statute §475.278, a brokerage relationship is established only through a written agreement signed by both the brokerage and the consumer. Home evaluation or valuation requests submitted through the Site are informational only and do not constitute a formal appraisal or a commitment to represent you.

IDX information is provided exclusively for consumers’ personal, non-commercial use and may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing. Information is deemed reliable but is not guaranteed accurate by the MLS or Home Wise Realty Group, Inc.

Property listing data displayed on this Site is sourced from one or more Multiple Listing Services (MLS) through an Internet Data Exchange (IDX) program. The MLS and its participating brokers are the owners of the data and retain all proprietary rights thereto.

Listing information is subject to change without notice. All listings are subject to prior sale, change, or withdrawal. HWRG shall not be liable for any inaccuracy, error, or omission in the listing data. Property data may not reflect the current status of a listing at the time you view it.

Users are strongly encouraged to independently verify all property details including, without limitation: square footage, lot size, room dimensions, property features, school district assignments, zoning, HOA fees, and any other material facts before making any real estate decision.

Use of IDX data is governed by NAR IDX Policy 7.58 and the rules of the applicable MLS. Any commercial use of MLS/IDX data is strictly prohibited. See Section 7 (Prohibited Uses) for more detail.

To access certain features of the Site, such as saving searches, receiving property alerts, or requesting home evaluations, you must create an account.

• Age Requirement: You must be at least 18 years of age to create an account or use the Site.
• Registration Methods: The Site supports account creation via email and password, Google OAuth, or a passwordless magic link sent to your email address.
• Accurate Information: You agree to provide truthful, accurate, current, and complete information during registration and to keep your account information updated at all times.
• Account Security: You are solely responsible for maintaining the confidentiality of your login credentials. Do not share your password or magic link with any third party.
• Account Activity: You are responsible for all activity that occurs under your account, whether or not authorized by you. Notify us immediately at info@homewisefl.com if you suspect unauthorized access.
• Suspension & Termination: HWRG reserves the right to suspend, restrict, or terminate your account at any time, with or without notice, for violation of these Terms or any conduct that HWRG deems harmful to the Site or its users.

The Site may allow you to submit certain content, including but not limited to contact form submissions, property inquiry messages, saved search names, property notes, and home evaluation requests (collectively, “User Content”).

By submitting User Content, you grant HWRG a non-exclusive, worldwide, royalty-free license to use, store, process, and display your User Content solely to the extent necessary to provide the services requested by you. We do not claim ownership of your User Content.

You represent and warrant that: (a) you own or have the right to submit the User Content; (b) your User Content is accurate and not misleading; and (c) your User Content does not violate any applicable law or the rights of any third party.

HWRG reserves the right, but not the obligation, to review, edit, refuse to post, or remove any User Content at its sole discretion for any reason, including content that violates these Terms or that HWRG finds objectionable.

You agree that you will not use the Site or its content for any of the following purposes:

• Using MLS/IDX data or any Site content for any commercial purpose, including aggregation, resale, redistribution, or incorporation into competing services
• Scraping, data mining, crawling, spidering, or using automated means to collect content, data, or information from the Site
• Attempting to gain unauthorized access to any account, computer system, network, or database connected to the Site
• Impersonating any person or entity, including any HWRG agent, employee, or another user
• Interfering with, disrupting, or degrading the operation of the Site or other users’ access to the Site, including through denial-of-service attacks or the introduction of malicious code
• Using the Site for any unlawful, fraudulent, or deceptive purpose
• Reproducing, publishing, distributing, or creating derivative works from Site content without prior written permission from HWRG
• Transmitting unsolicited commercial messages, spam, or chain letters through any Site feature or to other users of the Site

Violation of these prohibitions may result in immediate account termination and may expose you to civil and/or criminal liability.

The Site and all of its content, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, software, and the overall design and compilation of the Site, are the property of HWRG or its content suppliers and are protected by United States and international copyright, trademark, and other intellectual property laws.

MLS/IDX listing data displayed on the Site is owned by the respective listing brokers and the applicable Multiple Listing Service. HWRG has a limited license to display this data subject to MLS and NAR IDX rules. No ownership rights in listing data are transferred to users of the Site.

DMCA Copyright Notice. If you believe that any content on the Site infringes your copyright, please send a written notice of claimed infringement to info@homewisefl.com. Your notice must include:

1. Identification of the copyrighted work you claim has been infringed
2. Identification of the material on the Site that you claim is infringing, with sufficient detail to locate it
3. Your name, mailing address, telephone number, and email address
4. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf

The mortgage calculator tool available on the Site is provided solely for general informational and educational purposes. Results generated by the calculator are estimates only based on the inputs you provide and publicly available rate assumptions.

The mortgage calculator does not constitute:

• Financial, investment, or mortgage advice of any kind
• A loan pre-qualification, pre-approval, or commitment to lend
• A guarantee or lock of any interest rate or loan terms

Actual mortgage rates, monthly payments, loan fees, and eligibility depend on many factors including your credit score, debt-to-income ratio, down payment, loan type, lender policies, and current market conditions. These factors may cause actual figures to differ significantly from calculator estimates.

Property tax and homeowner’s insurance figures used in payment estimates are approximations only. Please consult a licensed mortgage loan originator or financial advisor for accurate figures tailored to your specific financial circumstances.

The site and all content, information, services, and materials available through the site are provided “as is” and “as available” without warranties of any kind, either express or implied.

To the fullest extent permitted by applicable law, HWRG expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

HWRG makes no warranty or representation that: (a) the site will meet your requirements; (b) the site will be available on an uninterrupted, timely, secure, or error-free basis; (c) property listings or other information on the site will be accurate, complete, reliable, current, or free of errors; or (d) any defects in the site will be corrected.

You expressly acknowledge that the use of the Site is at your sole risk and that you are solely responsible for any damage to your computer or other device or loss of data that results from use of the Site.

To the maximum extent permitted by applicable law, in no event shall HWRG, its officers, directors, employees, agents, licensors, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, business interruption, or the cost of substitute services, arising out of or in connection with your use of or inability to use the site or its content.

HWRG’s total cumulative liability to you for all claims arising out of or related to your use of the site shall not exceed the greater of: (a) one hundred dollars ($100.00); or (b) the total fees actually paid by you to HWRG during the twelve (12) months immediately preceding the event giving rise to the claim.

This limitation of liability applies regardless of the legal theory on which the claim is based, including contract, tort, negligence, strict liability, or any other legal or equitable theory, and even if HWRG has been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you in full. In such jurisdictions, HWRG’s liability shall be limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless HWRG and its officers, directors, shareholders, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys’ fees) arising out of or relating to:

• Your access to or use of the Site or any of its content
• Your violation of any provision of these Terms
• Your unauthorized use or commercial exploitation of MLS/IDX listing data obtained through the Site
• Any false, inaccurate, or misleading information submitted through any form or feature of the Site
• Your violation of any applicable federal, state, or local law or regulation
• Your infringement of any intellectual property or other rights of any third party

HWRG reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. You agree to cooperate fully with HWRG in asserting any available defenses.

The Site may contain links to or integrations with third-party websites, services, or resources that are not owned or controlled by HWRG. These may include, but are not limited to, links to mortgage lenders, home inspectors, title companies, insurance providers, and mapping services such as Google Maps.

HWRG does not endorse, approve, control, or assume responsibility for any third-party website, service, content, advertising, product, or resource. HWRG is not responsible for the availability, accuracy, reliability, or legality of any third-party content.

Any dealings you have with third parties found through or linked from the Site, including the delivery of goods and services and payment for such goods or services, are solely between you and the applicable third party. You access and use third-party websites and services entirely at your own risk, and subject to the terms and conditions and privacy policies of those third parties.

By creating an account or subscribing to property alerts or search notifications, you consent to receive email communications from HWRG. These communications may include:

• New listing alerts matching your saved search criteria
• Price change and status update notifications for saved properties
• Account-related messages (registration confirmation, password reset, security alerts)
• Periodic market updates and educational content (if opted in)

All marketing and promotional emails from HWRG comply with the CAN-SPAM Act. Every such email will include: (a) a clear identification of HWRG as the sender; (b) our physical mailing address at 217 N Westmonte Drive #2012, Altamonte Springs, FL 32714; and (c) a clear and conspicuous mechanism for you to opt out of receiving future marketing emails.

Unsubscribe requests submitted through the opt-out link in any email will be processed and honored within 10 business days of receipt. Please note that transactional and account-related emails—such as password reset requests, security notifications, and account activity alerts—are necessary for the operation of your account and cannot be unsubscribed from while your account remains active.

Use of this Site does not create a brokerage relationship of any kind between you and HWRG or any of its licensed agents.

Pursuant to Florida Statute §475.278, Florida law recognizes three types of brokerage relationships:

• Transaction Broker: The broker assists the buyer and/or seller in a real estate transaction but does not represent either party as a fiduciary. This is the default relationship in Florida.
• Single Agent: The broker represents only one party (either the buyer or seller) and owes that party full fiduciary duties.
• No Brokerage Relationship: The broker works with a buyer or seller without representing them in any capacity.

A brokerage relationship with HWRG is only established when both you and HWRG have signed a written brokerage agreement specifying the nature of the relationship. Dual agency (representing both buyer and seller as a single agent) is prohibited under Florida law.

These Terms and any dispute or claim arising out of or related to them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any conflict of law or choice of law provisions.

Subject to the dispute resolution provisions in Section 17, you and HWRG each consent to the exclusive personal jurisdiction of the state and federal courts located in Seminole County, Florida for the resolution of any dispute not subject to arbitration. You waive any objection to venue in such courts based on improper venue or inconvenient forum.

Severability. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms shall continue in full force and effect without modification.

We encourage you to contact us first if you have a concern. Most disputes can be resolved quickly and informally. Please follow these steps before initiating any formal proceeding:

1. Step 1 — Informal Resolution: Send a written description of your dispute to info@homewisefl.com. You and HWRG agree to negotiate in good faith for a period of 30 days from the date HWRG receives your notice before either party initiates arbitration or litigation.
2. Step 2 — Binding Arbitration: If the dispute is not resolved through informal negotiation, it shall be submitted to final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitration shall be conducted in Seminole County, Florida, or by telephone or videoconference at either party’s request.

Class Action Waiver: You agree that any arbitration or legal proceeding shall be conducted solely on an individual basis and not as a class action, consolidated action, or representative action. You expressly waive any right to participate in any class action lawsuit or class-wide arbitration relating to the site or these terms.

Exceptions. Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights. Either party may also bring an individual claim in small claims court provided the claim qualifies and remains in such court.

HWRG reserves the right to modify, update, or replace these Terms at any time at its sole discretion. We will determine whether a change is material based on its potential impact on your rights and obligations under these Terms.

Notification of Material Changes: For any material changes to these Terms, HWRG will provide at least 30 days’ advance notice by:

• Sending an email notification to registered users at the email address associated with their account
• Posting a prominent notice on the Site indicating that the Terms have been updated

Your continued use of the Site after any changes to these Terms become effective constitutes your binding acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Site before the changes take effect and may request deletion of your account by contacting us at info@homewisefl.com.

We recommend that you review this page periodically to stay informed of any updates. The “Last Updated” date at the top of this page indicates when these Terms were most recently revised.
